Cause of the Sentence
The sentence stems from an incident during the EFF’s fifth‑anniversary celebrations in Mdantsane in 2018, where Malema was seen to have triggered a semi‑automatic rifle into the air. Prosecutors argued that he unlawfully possessed the firearm and discharged it in a public space, violating multiple firearm‑control laws.
Magistrate Twanet Olivier emphasized that the act was not impulsive, describing it as a planned feature of the event, contradicting Malema’s defence that the shots were merely celebratory. The court found him guilty on several counts, including unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm in a public area, reckless endangerment, and related public‑safety violations.
Olivier stated that Malema knew the act was unlawful and that it carried potential harm to people and property. She rejected the argument that the rifle was a toy or firing blanks, noting that evidence and video footage confirmed the weapon’s authenticity and the deliberate nature of the act.
Courtroom and Political Reactions
Malema, 45, appeared composed as the sentence was read, and his legal team immediately filed an appeal, temporarily preventing his imprisonment while the case proceeds to higher courts. Hundreds of EFF supporters gathered outside the courthouse, chanting in solidarity as the news broke.
The ruling carries significant political implications. If upheld, the sentence could disqualify Malema from serving in Parliament, posing a major setback for the EFF, which has positioned itself as a radical alternative in South African politics.
Malema maintains that the case is politically motivated, but the court stressed that the conviction targets an individual, not a political party, reaffirming the judiciary’s independence.
